Quick summary

You use Masajid Manager to manage members, donations, subscriptions, and campaigns for your organization. You own your data. We provide the software and integrations. You’re responsible for your policies, fees, taxes, and compliance. Subscriptions auto-renew unless canceled. Some features rely on third-party gateways (e.g., Stripe). Please read the full terms, especially Billing, Acceptable Use, Data & Privacy, Disclaimers, and Liability.

1) Acceptance of Terms

By creating an account, or using any part of the Service, you agree to these Terms & Conditions and our Privacy Policy. If you are using Masajid Manager on behalf of a mosque or organization, you represent that you have authority to bind that organization. If you do not agree, do not use the Service.

2) Definitions

  • “Customer,” “You”: the mosque, Islamic center, nonprofit, or organization using Masajid Manager.
  • “Members”: individuals registered under your organization (including families, dependents, or seat holders).
  • “Donors”: individuals who donate via your public pages or kiosk.
  • “We,” “Us,” “Masajid Manager”: the Service provider operating the Masajid Manager platform.
  • “Workspace/Tenant”: your dedicated, branded instance (e.g., yourmasjid.mmscloud.com).
  • “Gateways”: third-party payment providers (e.g., Stripe) you connect to the Service.

3) Eligibility & Accounts

You must be of legal age to form a binding contract and provide accurate information. You are responsible for safeguarding credentials, enabling security features (e.g., 2FA), and all activity in your workspace.

4) Provisioning & Branding

During signup, you select a package, billing period (monthly/annual), and request a subdomain. We may refuse or change subdomains that are already taken or inappropriate. You can upload your logo, colors, and portal title for white-label branding.

5) Plans & Billing

  • Subscription: Plans are billed in advance. Charges are non-refundable except where we explicitly state otherwise or where required by law.
  • Taxes: Prices may exclude taxes. You are responsible for applicable taxes, duties, and assessments.
  • Late/Failed Payments: We may suspend or limit access after reasonable notices if payment fails.

6) Payment Processing & Merchant of Record

Masajid Manager is the software provider, not a bank, money transmitter, or charity. When you accept donations or membership payments, you (the Customer) are the merchant of record. Funds settle through your connected Gateway account under your agreement with that provider. Masajid Manager does not hold donor funds and is not responsible for Gateway decisions, chargebacks, or withholding.

7) Memberships, Subscriptions & Entrance Fees

You control your membership Types (Individual/Family/Organization), Categories/Plans, fees (including entrance/one-time fees), and renewal rules. You’re responsible for presenting accurate pricing and benefits to Members, including any taxes, discounts, refunds, or grace periods.

8) Donations & Campaigns

You can accept one-time and recurring donations, create campaigns with goals/timelines, and issue receipts. You are solely responsible for any charitable registrations, tax acknowledgments, and compliance in your jurisdiction. Masajid Manager provides tools to generate receipts; Masajid Manager does not provide tax or legal advice.

9) Kiosk & Hardware

The Kiosk Module supports member identification (via digital card, QR code, NFC, or mobile OTP) and guest donations. You are responsible for purchasing the necessary hardware (tablet, readers, printers), ensuring secure placement, and maintaining network connectivity. Masajid Manager is not liable for any device loss, theft, or misconfiguration.

10) Digital Membership Cards

Masajid Manager can issue digital cards. Cards are for identity/access and may enable faster kiosk transactions. You must promptly revoke lost or misused cards and maintain appropriate access controls at your venues.

11) Acceptable Use

You agree not to:
  • Violate laws or third-party rights; engage in fraud, money laundering, or sanctions violations.
  • Upload unlawful, harmful, or infringing content.
  • Attempt to bypass security, test vulnerabilities, or disrupt the Service.
  • Misrepresent fees, benefits, or donation uses to Members/Donors.
  • Share or resell access to unauthorized parties.
  • We may suspend or terminate accounts for violations.

12) Data Ownership, Privacy & Backups

  • Your Data: You own your member, donor, and transaction data.
  • Our Use: You grant Masajid Manager a limited license to process data solely to deliver the Service, support, analytics, and security.
  • Privacy: Collection and use are governed by our Privacy Policy. For regulated regions, a Data Processing Addendum (DPA) may apply.
  • Backups & Export: We maintain routine backups for continuity, but you should export critical data regularly. Upon written request and subject to plan features, you may export your data.

13) Security

Masajid Manager uses industry-standard safeguards (encryption in transit, audit logs, optional 2FA). You must configure roles/permissions appropriately, keep devices patched, and notify us promptly of suspected breaches.

14) Availability, Maintenance & Beta Features

We aim for high availability with planned maintenance windows. From time to time we may offer Beta or experimental features “as-is,” which may change or be withdrawn at any time.

15) Third-Party Services & Integrations

Some features rely on third parties (e.g., payment gateways, SMS/email providers). Your use of those services is subject to their terms and privacy policies. Masajid Manager is not responsible for third-party outages or decisions.

16) Intellectual Property

Masajid Manager, including software, designs, logos, and documentation, is owned by us or our licensors. We grant you a limited, non-exclusive, non-transferable license to use the Service for your internal operations, subject to these Terms. You may not reverse engineer or create derivative works of the Service.

17) Feedback & Publicity

If you submit product feedback, you grant Masajid Manager a royalty-free license to use it to improve the Service. Unless you opt out, we may display your organization’s name and logo as a customer reference (never donor/member data).

18) Term, Suspension & Termination

These Terms begin when you create an account and continue until terminated. You may cancel at any time in the Admin Console; cancellations take effect at the end of the current billing period. We may suspend or terminate for material breach, legal risk, or non-payment with reasonable notice where feasible.

19) Disclaimers

The Service is provided “as-is” and “as available.” We disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. Masajid Manager does not guarantee donation volume, member growth, or specific financial outcomes.

20) Limitation of Liability

To the maximum extent permitted by law: (a) Masajid Manager will not be liable for indirect, incidental, special, consequential, or punitive damages; and (b) Masajid Manager’s total liability arising out of or related to the Service will not exceed the fees paid by you to Masajid Manager in the 12 months preceding the event giving rise to the claim.

21) Indemnification

You agree to indemnify and hold harmless Masajid Manager from claims, damages, liabilities, and expenses arising from: (i) your misuse of the Service; (ii) your violation of laws or third-party rights; (iii) your pricing, donor communications, tax acknowledgments, or charitable registrations.

22) Changes to the Service or Terms

We may update the Service and these Terms from time to time. Material changes will be notified via email or in-app. Continued use after the effective date constitutes acceptance.

23) Governing Law & Dispute Resolution

These Terms are governed by the laws of California, USA, without regard to conflicts rules. Disputes will be resolved in state or federal court in Irvine, California, USA.

24) Agreement to arbitrate

You and Masajid Manager both Agree to Arbitrate. Before bringing a formal legal case, you must first contact our Customer Support team at Contact Us at https://www.MasajidManager.com. In the event that you and Masajid Manager cannot resolve the dispute through Customer Service, you and Masajid Manager both agree to arbitrate as described below.

By voluntarily accepting these Terms (and in many of our Services by voluntarily clicking or tapping an in-application button to affirmatively indicate your agreement to these Terms), you, Masajid Manager, agree to resolve any claims relating to the Terms, Feature Terms, Community Rules, your relationship with us, or Masajid Manager Services, through final and binding arbitration. This applies to all claims under any legal theory, unless the claim fits within the Exceptions to Agreement to Arbitrate identified below. This agreement to arbitrate also applies even after you stop using your Masajid Manager account or delete it. (In this Section 24 and in Section 25, you and Masajid Manager may be referred to individually as “a party” or collectively as “the parties.”)

An arbitration proceeding is before a neutral arbitrator instead of a judge and jury, so by voluntarily accepting these Terms, you and Masajid Manager agree to give up the right to a trial before a judge and jury. Arbitrations have different rules from lawsuits in court. They are less formal than lawsuits in courts and provide limited opportunities to force the other side to share information relevant to the dispute—a process called discovery. The arbitrator can award the same damages and relief on an individual basis that a court can award to an individual. But, if any party does not like the arbitrator’s decision, the courts only have a limited ability to change the outcome of arbitration or make the arbitrator reconsider his or her decision.

If any party disagrees about whether this agreement to arbitrate can be enforced or whether it applies to the dispute, the parties all agree that the arbitrator will decide that, too.

In addition, if you or Masajid Manager brings a claim in court that should be arbitrated, or any party refuses to arbitrate a claim that should be arbitrated, any other party can ask a court to force the parties to go to arbitration to resolve the claim (i.e., compel arbitration). You or Masajid Manager may also ask a court to halt a court proceeding (i.e., stay the court proceedings) while an arbitration proceeding is ongoing.

The American Arbitration Association (“AAA”) will control any arbitration between you and Masajid Manager and AAA’s then-current rules and procedures, including the Supplementary Procedures for Consumer-Related Disputes, will be used. You can look at AAA’s rules and procedures on their website at www.adr.org. If something in these Terms is different from AAA’s rules and procedures, then the parties agree to follow these Terms instead.

25) No Class Actions

By voluntarily accepting these Terms (and in many of our Services by voluntarily clicking or tapping an in-application button to affirmatively indicate your agreement to these Terms), you and Masajid Manager agree that the parties can only bring a claim against each other on an individual basis.

  • The parties agree that neither you nor Masajid Manager can bring a claim as a plaintiff or class member in a class action, consolidated action, or representative action.
  • The parties agree that the arbitrator cannot combine more than one person’s claim into a single case, and cannot preside over any consolidated, class, or representative arbitration proceeding (unless the parties all agree to change this).
  • The parties agree that the arbitrator’s decision or award in one person’s case can only impact the person who brought the claim, not other Masajid Manager users, and cannot be used to decide other disputes with other users.

26) Notices

If you wish to give us notice of something according to the Terms, Feature Terms, or Community Rules, the notice must be in writing and addressed to the following address unless we have provided a more specific way of notifying us:
Masajid Manager
Attn: Legal Dept.
2102 Business Center Drive
Suite 130
Irvine, CA 92612

27) Entire Agreement & Severability

These Terms, the Privacy Policy, and any order forms or DPAs constitute the entire agreement. If any provision is unenforceable, the remainder remains in effect.
